Lens of Compassion (“Lens of Compassion”, “we”, “us” or “our”) respects your privacy and is committed to handling personal information responsibly, transparently and securely.
This Privacy Policy explains how we collect, hold, use and disclose personal information in connection with our website, Discovery Calls, counselling, personal transformation programs and related services.
We aim to manage personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) where those laws apply.

3. How We Collect Information
We generally collect information directly from you when you:

5. Discovery Calls and Client Information
Information disclosed during a Discovery Call may be used to understand your circumstances, clarify the issue you wish to address, assess whether your needs fall within the scope of our services and determine whether working together appears appropriate.
A Discovery Call is an evaluation and suitability conversation. Any assessment made during that conversation is not intended to constitute a medical, psychiatric or psychological diagnosis unless expressly stated otherwise by a suitably qualified professional acting within their professional scope.
6. Disclosure of Information
We do not sell your personal information.
We may disclose information where reasonably necessary to service providers who assist us with matters such as:

-
email and communications;
-
video conferencing;
-
cloud storage and record management;
-
accounting, legal or professional services;
-
cybersecurity and technical support; and

Information shared during private sessions is treated confidentially.
Confidentiality is not absolute. Information may be disclosed where you consent to disclosure, where disclosure is required or authorised by law, or where another lawful exception applies.
Where circumstances raise concerns about serious and imminent risks to safety, we will act consistently with applicable privacy law, legal requirements and any relevant professional obligations.
8. Overseas Service Providers
Lens of Compassion uses third-party technology providers including Wix and Wix Payments, Stripe, and Google, including Google Meet, to operate the website, manage bookings and payments, communicate with clients, and deliver online services.
These providers operate internationally and may process, store or disclose personal information outside Australia. Depending on the service used and the provider’s current infrastructure, overseas recipients may be located in countries including Israel, the United States, Ireland and other countries within the European Economic Area, as well as other jurisdictions in which these providers or their authorised sub-processors operate.
Stripe advises that personal data may be transferred internationally, including to the United States, and that entities in the United States and Ireland may be involved in its processing activities. Google operates servers globally and states that information may be processed outside the country in which the individual resides.
Where the Australian Privacy Principles apply, we take reasonable steps appropriate to the circumstances to ensure overseas disclosures are handled consistently with applicable Australian privacy requirements.
Because the infrastructure and sub-processors used by global technology providers may change from time to time, the precise countries involved may also change. Further information is available in the respective privacy policies of Wix, Stripe and Google.
9. Payments
Payments may be processed through third-party payment providers including Wix Payments and Stripe.
Lens of Compassion does not ordinarily receive or retain your complete payment-card details. Payment information is processed by the relevant payment provider in accordance with its own privacy, security and regulatory obligations.
We may retain transaction information such as your name, payment status, amount paid, invoice details and transaction reference where required for administration, accounting or legal purposes.
10. Cookies and Website Analytics
Our website may use cookies and similar technologies to operate correctly, remember preferences, understand website activity, improve performance and measure the effectiveness of our content.
Some cookies may be provided by third parties such as Wix or analytics providers.
Where required, you may be given choices regarding non-essential cookies through the website’s cookie settings.
11. Marketing Communications
Where permitted by law, we may send information about Lens of Compassion, relevant services or resources where you have consented or would reasonably expect to receive those communications.
You may unsubscribe at any time using the unsubscribe function provided or by contacting us.

No internet-based system can be guaranteed to be completely secure. Where a data breach occurs, we will investigate and respond in accordance with applicable law, including the Notifiable Data Breaches scheme where it applies.
13. Retention of Information
We retain personal information only for as long as reasonably required for the purposes for which it was collected, to provide services, maintain appropriate business or client records, or comply with legal, insurance or professional obligations.
When information is no longer required and no legal requirement requires its retention, we take reasonable steps to destroy it securely or de-identify it.
14. Accessing or Correcting Your Information
You may request access to personal information we hold about you or ask us to correct information that is inaccurate, incomplete, out of date, irrelevant or misleading.

We will respond within a reasonable period and in accordance with applicable privacy law. In limited circumstances, the law may permit or require us to refuse access or correction. Where required, we will explain the reason.

Lens of Compassion does not currently arrange for computer programs to use personal information to make decisions that could reasonably be expected to significantly affect an individual’s rights or interests.

These Terms & Conditions govern your use of the Lens of Compassion website and your purchase or use of services provided by Dominique Braun trading as Lens of Compassion (“Lens of Compassion”, “Dom”, “we”, “us” or “our”).
By purchasing a service, reserving a paid session or otherwise agreeing to commence an engagement with Lens of Compassion, you acknowledge that you have read and agree to these Terms.
1. Our Services
Lens of Compassion provides private one-on-one counselling, personal development and personal transformation services, including The Breakthrough Protocol, Discovery Calls and associated client support.
Services may be provided online and, where specifically agreed, in person.
The nature, duration, inclusions and price of each service or package will be those displayed at the time of purchase or otherwise agreed in writing.
2. The Breakthrough Protocol
The Breakthrough Protocol is a personalised one-on-one engagement designed to support greater self-awareness, clarity, personal agency and meaningful change.
Different package options may provide different periods of access or numbers of sessions.
The work may involve exploring beliefs, behaviours, emotional responses, personal history, recurring patterns, goals, relationships, decision-making and other matters relevant to the outcome established between us.
3. Discovery Calls
A Discovery Call is complimentary and is not a free paid session.
Its purpose is to:
-
understand your current circumstances and desired outcome;
-
clarify the central issue or area requiring attention;
-
identify relevant patterns or considerations;
-
assess whether your needs fall within the scope of our work;
-
determine whether we are well suited to work together; and
-
where appropriate, recommend a potential direction forward.
You are under no obligation to purchase a program following a Discovery Call.
A Discovery Call does not constitute medical, psychiatric or psychological diagnosis or emergency care.
4. Suitability and Acceptance
Lens of Compassion is a selective service.
Submitting an enquiry or attending a Discovery Call does not guarantee acceptance into The Breakthrough Protocol.
We may decline to commence or continue an engagement where we reasonably believe that:

the service is not appropriate for your circumstances;
-
your needs fall outside our professional scope;
-
another form of support would be more appropriate;
-
there is an unresolved conflict of interest;
-
the working relationship is no longer constructive or safe; or
-
continuing would otherwise be inappropriate or unlawful.
Where appropriate, we may recommend that you seek assistance from another suitably qualified professional.
5. Client Participation
Meaningful personal change requires active participation.
You remain responsible for your own choices, decisions, behaviour and implementation of any strategies discussed.
You agree to participate honestly and respectfully, communicate material concerns where relevant, attend sessions as agreed and take reasonable responsibility for actions undertaken between sessions.
6. Outcomes
Our work is designed around meaningful and measurable progress wherever reasonably possible.
However, personal transformation involves individual circumstances and variables that cannot always be predicted or controlled.
Statements on our website about potential benefits, transformation, breakthroughs, testimonials or previous client experiences describe the intended purpose or possible outcomes of the work and do not constitute a guarantee that every client will achieve an identical result.
No specific outcome is guaranteed unless a particular written guarantee is expressly provided to you as part of your package.
7. Scope and Health Care
Lens of Compassion does not provide emergency, crisis, medical or psychiatric services.
The services are not a substitute for emergency care or for medical or mental-health treatment that is outside the scope of the services offered.
You should seek appropriate medical, psychological, psychiatric, legal, financial or other specialist advice where your circumstances require it.
Nothing said during a Discovery Call or service should be interpreted as a clinical diagnosis unless expressly provided by an appropriately qualified practitioner acting within their professional scope.
If you are experiencing an immediate threat to your safety or the safety of another person, contact emergency services or an appropriate crisis service in your location.
8. Eligibility
Unless otherwise agreed in writing, services are intended for adults aged 18 years or older.
If you access services from outside Western Australia, you are responsible for ensuring that your participation is lawful and appropriate in your jurisdiction. We reserve the right to restrict services where legal, professional or insurance requirements require us to do so.
9. Fees and Payment
Fees are those displayed or communicated to you before purchase.
Payment is required according to the payment arrangement selected at checkout or otherwise agreed in writing.
Prices are in the currency displayed at checkout and include GST where applicable.
Payments may be processed through third-party payment providers. Their terms and privacy practices may also apply to your transaction.
Where an instalment arrangement is offered, you remain responsible for payments in accordance with the agreed schedule unless otherwise required by law.
10. Session Packages and Validity
Unless otherwise agreed:
-
the 8 Session Pack is intended to be completed over eight weeks and must ordinarily be used within 12 weeks of commencement; and
-
the 12 Session Pack is intended to be completed over twelve weeks and must ordinarily be used within 16 weeks of commencement.
Extensions may be considered individually and require approval.
Nothing in this clause limits any rights you may have under Australian Consumer Law.
11. Reservations, Rescheduling and Cancellations
Reservations, rescheduling and cancellations are governed by the current Reservation & Cancellation Policy, which forms part of these Terms.
Generally:
-
online changes may be made up to 24 hours before a session;
-
requests within 24 hours require direct approval and cannot be guaranteed;
-
late cancellations may result in a session being treated as used or an applicable charge being imposed;
-
missed sessions will ordinarily be treated as used; and
-
reasonable exceptions may be considered according to the circumstances.
Any fee or consequence will be applied reasonably and subject to applicable consumer law.
12. Late Arrival
Clients are encouraged to be ready approximately 10 minutes before the scheduled session.
If you arrive late, the session will ordinarily still end at the scheduled time so sufficient privacy and preparation can be maintained between appointments.
Additional time may be provided where reasonably possible but cannot be guaranteed.
13. Technical Difficulties
You are responsible for maintaining a reasonably suitable device, internet connection and private environment for online sessions.
If technical difficulties occur, contact us as soon as possible.
Where a session is materially disrupted by circumstances beyond your reasonable control, we will consider an appropriate solution based on the circumstances.
14. Refunds and Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
Where Australian Consumer Law applies, services must be supplied with due care and skill, be fit for any applicable stated purpose, and be supplied within a reasonable time where no timeframe has been agreed.
Where a refund, cancellation or other remedy is required by law, your statutory rights will be honoured.
Where no refund is required by law, including where you simply change your mind, any full or partial refund, credit, transfer, extension or other accommodation may be offered at Lens of Compassion’s discretion, having regard to the circumstances, services already provided, sessions already reserved or used, and any costs reasonably incurred.
A change of mind does not automatically entitle you to a refund.
Nothing in this section affects any rights or remedies available to you under Australian Consumer Law.
15. Confidentiality
We treat private client communications and session information confidentially.
Information may nevertheless be disclosed where:

you consent;
-
disclosure is required or authorised by law;
-
disclosure is reasonably necessary in circumstances permitted under applicable privacy law; or
-
another lawful or professional obligation requires disclosure.

16. Session Environment and Recording
Neither party may record a private session without the prior express consent of the other party.
You are responsible for choosing a reasonably private environment for online sessions and taking reasonable steps to prevent unauthorised persons from hearing or accessing the conversation.
17. Intellectual Property
Unless otherwise stated, all original materials supplied by Lens of Compassion—including frameworks, written materials, worksheets, exercises, videos, program resources, branding and website content—remain the intellectual property of Lens of Compassion or the relevant rights holder.
Where materials are supplied as part of your package, you receive a personal, non-exclusive licence to use them for your own private purposes.
You must not reproduce, publish, sell, distribute, teach, licence or commercially exploit those materials without prior written permission.
18. Website Content
Website content is provided for general informational and educational purposes.
Although reasonable care is taken in preparing content, general website material cannot take into account your individual circumstances and should not be relied upon as personalised medical, psychological, legal or financial advice.
19. Testimonials and Examples
Testimonials, examples and descriptions of previous results reflect individual experiences.
They should not be interpreted as representations that every client will achieve the same or substantially similar outcomes.
20. Third-Party Services
Our website and services may depend on third-party platforms for matters such as payments, bookings, video conferencing, website hosting or communications.
We are not responsible for interruptions or failures wholly outside our reasonable control, although we will take reasonable steps to assist where those failures materially affect a service you have purchased.
21. Limitation of Liability
To the maximum extent permitted by law, Lens of Compassion is not liable for losses arising solely from decisions or actions you independently take after receiving our services where those decisions fall outside our reasonable control or contrary to advice provided.
Nothing in these Terms excludes liability or rights that cannot lawfully be excluded, including rights under Australian Consumer Law.
22. Respectful Conduct and Termination
We reserve the right to suspend or terminate an engagement where there is threatening, abusive, discriminatory, harassing or otherwise seriously inappropriate conduct.
We may also end an engagement where continuing is no longer reasonably appropriate, safe or within the scope of our services.
Where an engagement is ended, any question of unused fees or sessions will be dealt with fairly having regard to services already provided, the reason for termination and applicable Australian Consumer Law.
23. Privacy
Your use of our services is also subject to the Lens of Compassion Privacy Policy, which explains how personal and sensitive information is collected, used, stored and disclosed.
24. Changes to These Terms
We may update these Terms from time to time to reflect changes to our services, business practices or legal obligations.
Updated Terms will apply from the date published.
Changes will not retrospectively remove or materially reduce rights relating to a service already purchased unless required by law or agreed with you.
25. Governing Law
These Terms are governed by the laws applicable in Western Australia, Australia.
Subject to any rights you may have to bring proceedings elsewhere under applicable law, disputes will be subject to the jurisdiction of the courts and tribunals of Western Australia.

If you have a concern about your service, payment or these Terms, we encourage you to contact us first so we can attempt to resolve the matter promptly and fairly.
